12.2 Service Disclaimers

We provide our Services with reasonable care and skill. However, we do not guarantee:

If you are a consumer, this section does not affect your statutory conformity rights for digital content and digital services under Dutch law (Book 7 of the Dutch Civil Code, implementing Directive (EU) 2019/770), as described in Section 16.

To the maximum extent permitted by Dutch law, our liability is limited to direct damages, up to €100 or the fees you paid us in the last 12 months, whichever is higher.

If a third party brings a claim against us because your User Content or your use of the Services was unlawful or infringed that third party’s rights, you will compensate us for the resulting damages and reasonable costs, except to the extent the claim is attributable to us. 15.1 Governing Law

These Terms are governed by Dutch law. If you are a consumer, you also enjoy the protection of any mandatory provisions of the law of your country of residence.

15.2 Jurisdiction

Disputes will be submitted to the competent Dutch court, being the court of the district in which My Food Forest B.V. has its registered office (Rechtbank Noord-Nederland), unless mandatory law designates another court.

If you are a consumer, you may also bring the dispute before the court that is competent under statutory rules. If we invoke this jurisdiction clause against you, you have one month from the moment we do so in writing to choose the court that is competent under statutory rules.

15.3 Alternative Dispute Resolution

Before pursuing legal action, we encourage resolution through:

16. Consumer Rights (EU/Dutch Law)

If you purchase a paid digital service from us as a consumer, you have a 14-day right of withdrawal. For digital content or services delivered immediately, you only lose this right if you expressly consent to immediate performance and acknowledge that you thereby lose your right of withdrawal (Article 6:230p of the Dutch Civil Code). As long as our Services are free of charge, no right of withdrawal applies because there is no purchase.

16.2 Conformity Rights

Digital services must conform to the contract. If they don’t, you may be entitled to repair, replacement, price reduction, or contract termination.

16.3 Unfair Terms

Unfair contract terms are not binding on consumers under Dutch and EU law.

17. Force Majeure

We are not liable for delays or failures due to circumstances beyond our reasonable control, including natural disasters, government actions, internet outages, or other force majeure events.

18. Severability

If any provision of these Terms is found invalid or unenforceable, the remaining provisions will continue in full force and effect.

19. Assignment

We may transfer our rights and obligations under these Terms to a third party in connection with a merger, acquisition, restructuring, or sale of assets. We will notify you of such a transfer, after which you may terminate your Account free of charge if you do not wish to continue with the new party. You may not assign your rights under these Terms without our written consent.

We may update these Terms from time to time. For material changes, we will notify you at least 30 days before they take effect through:
